Parliamentary Inquiry into Foreign Bribery laws

On 10 January 2020, the AICD provided a submission to the Senate Legal and Economic Affairs Committee in response to the consultation on the Crimes Legislation Amendment (Combatting Corporate Crime) Bill 2019 (Bill), aimed at addressing challenges associated with investigating and prosecuting corporations for foreign bribery offences.


While the AICD supports a strengthening of Australia’s foreign bribery laws, we have responded to the Bill’s inquiry with a particular focus on ensuring that both the Bill’s proposed failure to prevent foreign bribery offence and operation of a DPA scheme do not run counter to well-established principles of natural justice and procedural fairness – presenting an unfair disadvantage to a defendant corporation in court proceedings.
