AICD letter to Minister for Home Affairs re Critical Infrastructure Bill

Thursday, 26 August 2021

On 26 August, the AICD sent a letter to the Minister for Home Affairs noting our concern with certain elements of the Security Legislation Amendment (Critical Infrastructure) Bill 2020 (SOCI Bill).

In particular, we consider that as currently drafted the immunity provisions contained in the SOCI Bill are too narrow and may expose directors to personal liability in certain rare circumstances. In our letter we suggested alternate drafting based on the Banking Act that would allay our concerns. .
