On 14 February 2020, the AICD provided a letter to the Western Australian State Government regarding the introduction of the Work Health and Safety Bill 2019 (WA) (Bill).


While the AICD strongly supports robust and effective laws that ensure the health and safety of employees in the workplace, we have material concerns that the Bill goes further than the recommendations coming out of Safe Work Australia’s inquiry into the effectiveness of the national model work health and safety (WHS) laws by independent expert, Marie Boland (Boland Review) and its counterparts in other States and Territories.

In particular, the proposed introduction of two new industrial manslaughter offences, the application of strict liability to a Category 1 offence and the blanket prohibition on director and officer insurance and indemnity arrangements against fines in a WHS context.
